Monsieur le Président,

La Cour Suprême des États-Unis vient de rejeter le recours du journaliste
Mumia Abu-Jamal, condamné à mort en 1982 au terme d’un
procès dont l’iniquité est internationalement reconnue.

Cet homme qui ne demande qu’à défendre son innocence se
voit ainsi refuser tout nouveau procès.

Cette décision de la plus haute autorité juridictionnelle constitue une
atteinte aux droits humains les plus élémentaires. Elle bafoue gravement
la Constitution américaine eu égard aux conditions de déroulement
du procès et à la sélection du jury selon des critères raciaux.

La gravité de la situation appelle une intervention de votre
part pour faire respecter les droits de cet homme et empêcher
que l’irréparable ne soit commis.

Aussi, nous vous demandons instamment d’user de votre autorité morale
pour mettre un terme à l’acharnement judiciaire
dont est victime Mumia Abu-Jamal, figure emblématique
du combat universel contre la peine de mort.
L’opportunité vous est donnée de mettre votre pays
en phase avec l’immense espoir soulevé par votre
élection, celui de contribuer à l’éradication de la souffrance
humaine. Et ce sens, il y a urgence à mettre en
oeuvre un moratoire contre la peine de mort comme
vous y invite la Résolution de l’Organisation des Nations
Unies. Une telle décision grandirait assurément
l’image des États-Unis d’Amérique.
YES, YOU CAN, sauver Mumia Abu-Jamal et
abolir la peine de mort !

President Obama,
Death-row inmate Mumia Abu-Jamal lost his bid for a new trial in the killing
of a Philadelphia police officer after the U.S. Supreme Court said on April 6,
2009, it would not take up his case.

Abu-Jamal, a former Black Panther and one-time radio reporter, had claimed
prosecutors improperly excluded blacks from the jury that convicted him of
murdering white Philadelphia police officer Daniel Faulkner in 1981.

Abu-Jamal’s attorney, Robert R. Bryan of San Francisco, called his client’s trial
“a mockery of justice” and Amnesty International determined, in its 2000 report,
“that (…) based on its review of the trial transcript (…) numerous
aspects of this case clearly failed to meet minimum standards safeguarding
the fairness of legal proceedings (…) and the interests of justice would best
be served by the granting of a new trial to Mumia Abu-Jamal”.

In March 2008, the 3rd U.S. Circuit Court of Appeals in Philadelphia upheld
Abu-Jamal’s conviction but ruled his death sentence invalid.
The appeals court found the jury was given flawed
instructions during the penalty phase of his trial.

Since Abu-Jamal’s conviction, activists in the United States
and Europe have rallied in support of his claim that he was
the victim of a racist justice system and this case was ‘legal
lynching’. Abu-Jamal, 55, has kept his case in the spotlight
through books and radio broadcasts. He has become
the icon of the world wide movement for the Abolition of
Death Penalty.

As newly-elected President of the UNITED STATES of AMERICA
you have become the icon of the American Dream for
Justice and Equality.

Please help abolish legal lynching and Death Penalty as required
by RESOLUTION passed by the NATO in December 2009 which
declared a MORATORIUM on DEATH PENALTY WORLD WIDE.
